Consent and safeguards for GPS and telematics processing.

Current published policyVersion GH-2026-10-21-v1Effective 2026-10-21
Effective-date notice: This policy is effective from 2026-10-21. Booking-specific accepted versions and applicable mandatory law remain controlling for transactions created under earlier accepted terms.

1. Purpose

This GPS Tracking Consent ("Consent") constitutes an explicit, affirmative, unbundled, and informed legal consent executed by the Renter and any Approved Driver, authorizing DRYVE247 LTD to continuously collect, process, record, transmit, and monitor real-time geolocation telemetry and diagnostic performance data from the vehicle during the Booking.

2. Scope

This Consent applies to all Trips, reservations, and driving activities executed by a Renter or Approved Driver on the DRYVE247 Platform.

3. Definitions

All capitalized terms not defined herein shall bear the meanings set forth in Document 21.

"Express Informed Consent" means unambiguous, affirmative consent provided via an unticked checkbox and digital confirmation, satisfying Section 20 of the Data Protection Act, 2012 (Act 843) and Article 18(2) of the 1992 Constitution.

4. Parties Covered

This Consent legally binds the individual Renter, each Approved Driver, and DRYVE247 LTD.

5. Eligibility

Providing this Consent is a mandatory condition of eligibility for completing a vehicle reservation or receiving driving authorization on the Platform.

6. Rights

Notice of Processing: You have the right to know the precise categories of telematics data collected, as detailed in Document 21.

Data Subject Rights: You retain statutory rights under Act 843 to request an audit of your personal tracking records, subject to platform retention limits and pending legal proceedings.

7. Responsibilities

Passenger Notice: The Renter assumes full responsibility for notifying all passengers that the Vehicle is equipped with active GPS tracking technology.

Non-Interference: The Renter and Approved Drivers agree not to obstruct, interfere with, or attempt to disable the transmission of tracking signals.

8. Prohibited Conduct

You shall not deploy signal dampeners, metallic shielding, or electronic GPS jammers to disrupt data transmissions.

9. Operational Procedures & Affirmative Acknowledgment

At the time of reservation checkout and during digital vehicle handover, the Renter must affirmatively review and click the designated consent mechanism:

AFFIRMATIVE TRACKING DECLARATION:

"I hereby expressly acknowledge and agree that the Vehicle I am booking is equipped with an active, hardwired 4G GPS telematics tracking device. I expressly consent to DRYVE247 LTD and the vehicle Host collecting, tracking, recording, and processing real-time vehicle geolocation coordinates, speed vectors, acceleration events, route history, ignition states, and diagnostic metrics throughout the duration of my Trip. I acknowledge that this data will be utilized for asset protection, verifying compliance with geographic boundaries (including international border prohibitions), calculating mileage and fuel levels, managing emergencies, adjudicating damage claims, and cooperating with the Ghana Police Service in the event of theft or serious collision. I understand that this consent is given freely as an essential condition of accessing the vehicle sharing services."

10. Evidence and Documentation Requirements

The electronic audit log recording your User ID, IP address, timestamp, device identifier, and the exact version of this Consent accepted is permanently archived in DRYVE247 production databases in compliance with the Electronic Transactions Act, 2008 (Act 772).

11. Payments and Financial Consequences

Consent execution carries no direct fee. However, attempting to withdraw consent during an active Trip while retaining possession of the vehicle constitutes an immediate material breach, triggering trip cancellation, engine immobilization upon stopping, and recovery dispatch charges.

12 Independent Insurance Responsibilities

Consent and Independent Insurance: GPS consent concerns data processing and platform safety. It does not purchase, activate or validate insurance. The Host remains responsible for confirming any tracking condition directly with its insurer.

13. Privacy and Data Protection

Data captured pursuant to this Consent is handled in strict compliance with the Data Protection Act, 2012 (Act 843), encrypted using TLS 1.3 in transit and AES-256 at rest.

14. Safety Obligations

Continuous tracking enables rapid deployment of roadside mechanical support and emergency medical services.

15. Reporting Obligations

Users must report any unexpected telematics app alerts immediately to the support center.

16. Disputes

Disputes regarding the scope or implementation of tracking consent shall be handled pursuant to Document 59.

17. Enforcement

If tracking telemetry ceases abruptly, DRYVE247 operations will immediately contact the driver; failure to respond permits DRYVE247 to treat the vehicle as compromised.

18. Suspension and Termination

Revocation of this Consent prior to physical vehicle return is legally impermissible while the vehicle remains in the Renter's custody.

19. Applicable Law

This Consent is governed by the laws of the Republic of Ghana, specifically Article 18(2) of the 1992 Constitution and Section 20 of the Data Protection Act, 2012 (Act 843).

20. International Users

International users acknowledge that tracking consent is legally valid and enforceable worldwide under cross-border data transfer and consent standards (including GDPR Article 6(1)(a)).

21. Amendments

Any amendment to the scope of tracking requires updated affirmative consent upon next booking.

22. Severability

If any provision herein is declared void, all other tracking authorizations remain operational.
