Incident Evidence Sharing Authorization

Limited authority to preserve and lawfully share necessary incident records. No insurance agency or settlement authority.

Current published policyVersion GH-2026-10-21-v1Effective 2026-10-21
Effective-date notice: This policy is effective from 2026-10-21. Booking-specific accepted versions and applicable mandatory law remain controlling for transactions created under earlier accepted terms.

1. Purpose

This Incident Evidence Sharing Authorization ("Authorization") permits limited preservation and lawful disclosure of relevant platform incident records for safety, contractual disputes and a specified independent insurance matter. It does not appoint DRYVE247 as an insurance agent, attorney-in-fact, claims manager, loss adjuster or settlement recipient and transfers no recovery rights.

2. Scope

This Authorization concerns records relating to a platform booking, collision, theft, damage or associated dispute. It authorizes evidence handling only, within the stated purposes and lawful disclosure basis.

3. Definitions

"Independent Insurer" means the licensed insurer with which a Host or other claimant has separately contracted. It has no platform underwriting or insurance-provision role created by this document.

"Incident Records" means relevant condition reports, booking records, photographs, telemetry and official reports lawfully held by DRYVE247. It excludes unrelated personal data and does not create a right to obtain restricted police or medical records.

4. Parties Covered

This Authorization governs the user giving assent and DRYVE247's handling of the stated records. It does not bind an independent insurer, third-party claimant, police authority or court.

5. Scope of Authority Granted

By specific electronic assent, the Host or Renter authorizes DRYVE247, only where necessary and lawfully permitted, to:

Preserve relevant platform incident records and provide copies to the verified user or an authorized lawful recipient;

Receive police reports supplied lawfully by the relevant user or authority; request restricted records only with any separately required authority;

Share the minimum necessary records with a specifically identified independent insurer or legal adviser for the stated matter, with a documented lawful basis;

Coordinate a vehicle safety inspection or transport under separate valid owner instructions; this does not authorize an insurance loss adjustment or repair settlement;

Maintain a disclosure log identifying the recipient, purpose, records shared and legal basis; DRYVE247 does not receive or distribute insurance proceeds;

Provide evidence needed for a contractual platform dispute. This grants no right to file or negotiate an insurance claim, agree a settlement, exercise subrogation or litigate in another person's name.

6. Rights

Access and Transparency: The affected user may request relevant records and disclosure information, subject to privacy, privilege and lawful access restrictions. No right to receive another person's confidential insurer file is created.

No Double Recovery: Platform damage calculations must account for relevant recoveries already received. Refund any contractual overcollection in accordance with Documents 11 and 15; DRYVE247 does not pursue insurer recoveries on users' behalf.

7. Responsibilities

User Responsibilities: Supply truthful incident records and report the event directly to the independent insurer where required. The Host or policy claimant remains responsible for claim forms, notices, insurer deadlines, legal representation and any separate cooperation duties.

Preserve Evidence: Do not alter records or purport to bind another party to a settlement. Seek advice directly from the insurer or a separately appointed representative about any release or policy condition; DRYVE247 does not act as that representative.

8. Prohibited Conduct

No person shall:

Submit fabricated records or misrepresent a person's authority to receive incident information;

Use this Authorization as an insurance power of attorney, subrogation assignment or authority to file, negotiate or settle a claim;

Direct an insurer to pay DRYVE247 as the recipient or distributor of a user's insurance settlement.

9 Incident Evidence Sharing Procedure

Upon the occurrence of an accident:

The user reports the event under Document 41; the Host or policy claimant separately notifies and deals directly with its independent insurer;

DRYVE247 preserves its relevant records, verifies the recipient and disclosure basis, and provides only necessary copies with a disclosure log;

The Host or policy claimant handles assessments, repair authorization and insurer settlement directly. Insurance proceeds are paid to the lawful policy payee under the insurer's arrangements, not through DRYVE247.

10. Evidence and Documentation Requirements

The file records the scope of assent, incident identifier, relevant booking and condition evidence, verified recipient, purpose, lawful basis and disclosures made. Obtain specific authority for sensitive material where required; do not collect unrelated medical or police information.

11. Payments and Financial Consequences

Financial Limits: This Authorization creates no premium, insurance commission, platform indemnity, reimbursement promise or authority over an insurer payment. Any contractual platform damage charge follows Documents 11, 12, 15 and 18 and must account for recoveries already received.

12 Independent Insurance Responsibilities

Separate Insurance Duties: The Host or policy claimant is responsible for complying directly with the actual policy. This Authorization does not submit an insurer notice, preserve cover, determine exclusions or guarantee claim acceptance or payment.

13. Privacy and Data Protection

Privacy Safeguards: Use a documented lawful basis, purpose limitation, recipient verification, data minimization, secure transfer, access controls and the retention schedule in Documents 24 and 29. Sensitive data and international transfers require the additional safeguards applicable to them.

14. Safety Obligations

Safety coordination must respect lawful owner instructions and manufacturer requirements. Evidence-sharing permission alone does not authorize repairs or any action reserved to the owner, insurer or competent authority.

15. Reporting Obligations

Users should promptly notify the Platform of demands relevant to its incident records and respond directly to insurer or court deadlines. Sending material to DRYVE247 does not constitute service on an insurer or appoint DRYVE247 as legal representative.

16. Disputes

Platform evidence-handling disputes follow Documents 30, 58 and 59 as applicable. Insurance claims and settlement disputes remain between the claimant, independent insurer and competent authorities.

17. Applicable Law

This Authorization is subject to applicable Ghanaian data protection, electronic-transactions, evidence and contract law. It is not a power of attorney or assignment of insurance or litigation rights.

18. International Users

International users may request lawful copies of relevant platform records after departure. They remain responsible for direct insurance and legal arrangements; DRYVE247 does not manage Ghanaian insurance claims for them.
