Safety, reporting timelines and evidence requirements following an incident.

Current published policyVersion GH-2026-10-21-v1Effective 2026-10-21
Effective-date notice: This policy is effective from 2026-10-21. Booking-specific accepted versions and applicable mandatory law remain controlling for transactions created under earlier accepted terms.

1. Purpose

This Accident and Incident Reporting Policy ("Policy") defines the mandatory emergency workflows, statutory reporting timelines, police notification duties, evidence preservation protocols, and claims notification requirements applicable whenever a Vehicle is involved in a collision, rollover, fire, injury incident, property damage event, or mechanical failure during a Trip booked on the DRYVE247 Platform.

2. Scope

This Policy applies to all Renters, Approved Drivers, Chauffeurs, Hosts, and vehicle occupants across all Trips completed in the Republic of Ghana.

3. Definitions

"Critical Safety Incident" means any collision resulting in personal bodily injury, fatality, structural vehicular frame damage, deployed airbags, vehicle immobility, or property damage to an uninvolved third party.

"Police Accident Report" means an official Police Station Diary Extract or formal Motor Traffic and Transport Department (MTTD) Accident Investigation Report issued by the Ghana Police Service.

"Reporting Deadline" means the strict time limit of two (2) hours within which an incident must be reported to DRYVE247.

4. Parties Covered

This Policy applies to DRYVE247, Renters, Approved Drivers, Chauffeurs and Hosts for platform incident reporting. It does not appoint an insurer partner or bind independent insurers.

5. Eligibility

Prompt reporting is a platform safety and evidence requirement. It does not preserve or guarantee insurance; the Host or policy claimant must separately meet its insurer's notification and policy conditions.

6. Rights

Emergency Support: Users have the right to 24/7 access to the DRYVE247 Emergency Support Line for post-accident guidance, medical dispatch coordination, and towing services.

Contractual Review: Users have access to an evidence-based platform damage review and dispute process. Insurance claims are submitted and managed directly by the Host or other claimant with the independent insurer.

7. Responsibilities

Safety First: The driver’s first duty is to ensure the physical safety of all occupants, check for injuries, and summon emergency medical assistance if required.

Statutory Police Notice: Under Section 23 of the Road Traffic Act, 2004 (Act 683), the driver must immediately report any accident involving personal injury or damage to third-party property to the nearest Ghana Police Service station within twenty-four (24) hours.

Platform Notice: The driver must report the incident to DRYVE247 Trust & Safety via the in-app emergency button or hotline within two (2) hours of occurrence.

8. Prohibited Conduct

No person shall:

Flee the scene of an accident (hit-and-run), which constitutes a severe crime under Section 23 of Act 683;

Purport to bind DRYVE247 to a third-party settlement or insurance claim. Give truthful reports and comply with the actual independent policy and any legal advice before admissions or settlements; DRYVE247 does not grant insurer consent;

Attempt to drive a vehicle with compromised steering, deployed airbags, leaking fluids, or frame damage;

Move the vehicle from the final rest position before capturing photographic evidence, unless instructed by a police officer to clear critical highway traffic.

Submission of Report: The driver must complete the in-app digital Incident Report Form within twelve (12) hours, attaching photos and the Police Station Diary Extract number.

10. Evidence and Documentation Requirements

The incident dossier must include:

Minimum eight (8) clear photos of the accident scene, vehicle damage close-ups, and third-party vehicles;

Certified copy of the official Ghana Police Service MTTD Accident Report;

Scanned copy of the third party's insurance sticker/certificate;

Timestamped telematics impact telemetry extracted by DRYVE247 engineers.

11. Payments and Financial Consequences

Late Reporting Surcharge: Failure to report an incident within the mandatory two-hour window incurs an administrative late-reporting fee of GH₵ 500 / USD $50.

Reporting Failures: Any contractual consequence must be supported by the evidence, accepted terms and law. DRYVE247 does not declare insurance void or automatically charge all uninsured loss because a platform reporting deadline was missed.

12 Independent Insurance Responsibilities

Separate Insurer Notice: A report to DRYVE247 is not notice to an insurer. The Host or other policy claimant must promptly notify its insurer directly and meet the policy's actual requirements. DRYVE247 does not file or manage the claim or guarantee indemnification.

13. Privacy and Data Protection

Incident records are processed for platform safety, contractual disputes and specific lawful disclosures under Documents 24, 29 and 64. Sharing records does not appoint DRYVE247 to administer insurance claims.

14. Safety Obligations

Warning triangles must be placed at least forty-five (45) meters behind the disabled vehicle pursuant to Regulation 83 of L.I. 2180 to prevent secondary collisions.

15. Reporting Obligations

The Host must report any accident notice received directly from a Renter or police officer to DRYVE247 immediately.

16. Disputes

Disputes regarding accident fault or reporting compliance shall be adjudicated under Document 12 and Document 59.

17. Enforcement

DRYVE247 Trust & Safety personnel have full authority to command towing and impound vehicles for forensic appraisal.

18. Suspension and Termination

Fleeing the scene of an accident results in immediate, permanent platform debarment and criminal referral.

19. Applicable Law

This Policy is governed by the laws of the Republic of Ghana, specifically the Road Traffic Act, 2004 (Act 683, Section 23), the Road Traffic Regulations, 2012 (L.I. 2180), and the Insurance Act, 2021 (Act 1061).

20. International Users

Foreign drivers are reminded that fleeing an accident scene is a non-bailable criminal offence in Ghana; foreign nationals must remain at the scene and contact platform emergency dispatch.

21. Amendments

Reporting procedures may be adjusted to incorporate digital police reporting integrations.

22. Severability

Invalidity of any clause shall not compromise the statutory duty to report accidents.
