1. Purpose
This Renter Agreement ("Agreement") constitutes a binding legal agreement governing the relationship between a verified Renter ("Renter", "you", or "your") and the designated Host ("Host") who lists and provides the Vehicle booked through the DRYVE247 Platform. DRYVE247 LTD acts as the intermediary platform provider and commercial collection agent facilitating this transaction.
2. Scope
This Agreement governs every reservation, checkout, physical handover, operational period, trip duration, return inspection, and post-trip liability assessment involving a Vehicle booked by a Renter on the Platform.
3. Definitions
All terms capitalized herein and not otherwise defined shall bear the meanings ascribed to them in the Master Terms of Service (Document 1).
"Check-In" means the formal digital inspection process conducted at the inception of a Trip, comprising 360-degree photography, odometer recording, fuel level confirmation, and digital signature exchange.
"Check-Out" means the concluding digital inspection process executed at the termination of a Trip, verifying the Vehicle’s return condition, mileage, fuel/charge level, and physical custody.
"Contractual Liability Limit" means any expressly accepted cap on the Host's contractual recovery from the Renter under Document 11. It is separate from any deductible or excess in the Host's independent insurance policy and does not promise payment of the remaining loss by DRYVE247 or an insurer.
"Incident" means any collision, scratch, dent, mechanical failure resulting from misuse, glass breakage, theft, vandalism, impoundment, or traffic violation occurring during the Trip.
4. Parties Covered
This Agreement legally binds the verified Renter, all registered and Approved Drivers added to the specific Booking, the Host (or licensed Fleet Operator), and DRYVE247 LTD as the facilitator, payment intermediary, and limited commercial agent.
5. Eligibility
To execute this Agreement and take custody of a Vehicle, the Renter must:
Be at least twenty-one (21) years of age (or older if specified for premium vehicle classes);
Hold a valid, unexpired driver’s licence issued by the Driver and Vehicle Licensing Authority (DVLA) of Ghana, or an approved foreign driver’s licence accompanied by an International Driving Permit (IDP) or authorized English translation;
Have successfully cleared all identity, criminal risk, and driving history checks administered via DRYVE247;
Maintain a valid payment method and sufficient available credit or funds to satisfy the rental cost and mandatory security deposit.
6. Rights
Quiet Enjoyment: The Renter has the right to peaceful, uninterrupted possession and lawful operation of the Vehicle throughout the authorized Trip period, provided all terms of this Agreement and the Prohibited Vehicle Use Policy are respected.
Roadworthy Vehicle: The Renter is entitled to receive a Vehicle that is clean, mechanically sound, safe, and possessing a valid DVLA roadworthiness certification and active statutory motor insurance disc.
7. Responsibilities
Care and Custody: You must treat the Vehicle with reasonable care, ensure it is locked and secured whenever unattended, operate it strictly in accordance with manufacturer specifications, and monitor engine temperature, oil pressure, and tyre pressure warning lights.
Designated Drivers Only: Only the Primary Renter and expressly vetted Approved Drivers may drive. Unauthorized driving is a material breach and may exclude an agreed Damage Waiver as expressly stated in Document 11; it does not authorize DRYVE247 to determine an insurer's obligations.
Punctual Return: You must return the Vehicle to the designated location at or before the scheduled Trip conclusion time, in the exact condition received (reasonable wear and tear excepted), with the required fuel or battery charge level.
8. Prohibited Conduct
The Renter shall NOT:
Operate the Vehicle while under the influence of alcohol, drugs, narcotics, or any intoxicating substances, or permit any driver to do so;
Use the Vehicle for commercial haulage, passenger carriage for hire (unless booked under an explicit commercial program), racing, speed contests, towing, off-road driving, or on roads unsuitable for the Vehicle type;
Sublease, sublet, pledge, transfer, or assign the Vehicle to any third party;
Transport hazardous, explosive, inflammable, toxic, or illegal substances under the laws of Ghana;
Drive outside Ghana without separate written permission from DRYVE247 and the Host, the required customs documents and evidence of suitable independently arranged territorial insurance. Platform permission does not arrange or extend insurance;
Disable, tamper with, cover, remove, or modify any GPS tracking device, telematics module, dashcam, or anti-theft hardware installed in the Vehicle.
9. Operational Procedures
Check-In Protocol: Prior to receiving the vehicle keys or taking drive control, the Renter must physically inspect the Vehicle alongside the Host (or via the digital lockbox flow), capture at least twelve (12) high-resolution timestamped photographs covering all four exterior corners, sides, tyres, glass, interior seats, dashboard gauges (odometer and fuel), and record any pre-existing blemishes in the app.
Check-Out Protocol: Upon trip conclusion, the Renter must repeat the comprehensive photographic inspection, record the final mileage and fuel level, park the vehicle lawfully, and obtain digital confirmation of return. Failure to complete this photographic protocol forfeits the Renter's right to challenge post-trip damage claims.
10. Evidence and Documentation Requirements
The digital Check-In and Check-Out condition reports, timestamped photographs, in-app communications, and telematics telemetry logs stored by DRYVE247 shall constitute the definitive evidentiary baseline for determining liability for damages, fuel shortages, late returns, or traffic fines under the Evidence Act, 1975 (NRCD 323).
11. Payments and Financial Consequences
Authorized Charges: The Renter expressly authorizes DRYVE247 to bill their credit card, debit card, or Mobile Money (MoMo) account for all trip fees, extensions, fuel replacement costs plus administrative surcharges, cleaning fees, towing costs, traffic tickets, tolls, and security deposit deductions.
Security Deposit Deductions: If damage or contractual defaults occur, the security deposit shall be frozen immediately pending independent repair appraisal pursuant to the Security Deposit Policy (Document 14).
Continuing Authorization: The Renter grants DRYVE247 an irrevocable continuing payment authorization to recover any outstanding balances, fines, or contractual damage charges that become liquidated within one hundred and eighty (180) days following trip completion.
12 Independent Insurance Responsibilities
Host Insurance Responsibility: The Host must obtain and maintain suitable commercial motor insurance directly with an independent licensed insurer under Document 10. DRYVE247 provides no insurance. Users must not assume a booking, payment or approved driver is automatically covered.
Damage Responsibility: The Renter is responsible for substantiated amounts under Document 11 and any expressly accepted contractual Damage Waiver. A waiver does not bind an insurer or third-party claimant, and an insurer's deductible does not automatically determine the Renter's liability.
Uncompensated Losses: Liability for loss is determined under the applicable agreements and law, taking account of proven responsibility and any valid waiver. DRYVE247 does not fund losses, guarantee insurer payments or automatically impose an insurer's uncovered balance on the Renter.
13. Privacy and Data Protection
The Renter acknowledges that the Vehicle is equipped with active GPS tracking and telematics technology that records real-time location, speed, harsh acceleration, impact events, and route history. The processing of this data is strictly regulated under the GPS Tracking and Telematics Policy (Document 21) and the Privacy Policy (Document 24), anchored in Act 843.
14. Safety Obligations
Renters must adhere to the provisions of the Road Traffic Act, 2004 (Act 683). The Renter must ensure that all vehicle occupants wear functional seatbelts at all times and that children are secured in appropriate child safety seats where required by law.
15. Reporting Obligations
In the event of an accident, mechanical breakdown, theft, or impoundment:
The Renter must immediately cease driving if it is unsafe or if continued operation could exacerbate vehicle damage;
Contact DRYVE247 Trust & Safety via the in-app emergency hotline within two (2) hours;
In any incident involving collision, injury, property damage, or theft, immediately report the matter to the Ghana Police Service (MTTD) and obtain an official Police Accident Report or Station Diary Extract.
16. Disputes
Any dispute between the Renter and the Host or DRYVE247 regarding damage claims, deposit forfeitures, or service quality shall be handled pursuant to the Deposit and Dispute Policy (Document 15) and resolved under the Alternative Dispute Resolution Act, 2010 (Act 798).
17. Enforcement
Failure to return the Vehicle within twenty-four (24) hours of the scheduled return time without approved extension or communication shall be treated as an unlawful conversion and vehicle theft under Section 120 of the Criminal Offences Act, 1960 (Act 29), resulting in immediate activation of remote telematics recovery, police notification, and criminal prosecution.
18. Suspension and Termination
DRYVE247 reserves the unilateral authority to terminate an active Trip immediately and command remote immobilization or repossession of the Vehicle if the Renter engages in reckless driving, exceeds speed thresholds repeatedly, enters an unauthorized border zone, or engages in financial fraud.
19. Applicable Law
This Agreement is governed by and construed in accordance with the laws of the Republic of Ghana.
20. International Users
International Renters operating vehicles in Ghana agree that local traffic laws, police procedures, and liability standards apply during their stay, and submit to the jurisdiction of Ghanaian courts and arbitral panels.
21. Amendments
No modification of this Agreement is valid unless executed through an official update by DRYVE247 or agreed to via written platform addendum.
22. Severability
If any term herein is deemed invalid or unenforceable by law, all remaining sections continue in full legal effect.
