1. Purpose
This Chauffeur Service Agreement ("Agreement") defines the operational, safety, and legal requirements applicable when a Vehicle booking on the DRYVE247 Platform includes the provision of an approved, professional driver ("Chauffeur") supplied by the Host, Fleet Operator, or DRYVE247 contractor network.
2. Scope
This Agreement applies to all Bookings designated as "With Driver" or "Chauffeured", governing the interactions among the Renter, the Chauffeur, the Host/Employer, and DRYVE247.
3. Definitions
All capitalized terms not defined herein shall bear the meanings set forth in preceding documents.
"Chauffeured Booking" means an authorized reservation where the Renter contracts for vehicle transportation driven exclusively by an approved professional Chauffeur.
"Driving Window" means the maximum permissible daily driving hours authorized for a Chauffeur under Ghanaian road safety rules and platform standards.
4. Parties Covered
This Agreement legally binds the Renter, the Host or Fleet Operator supplying the Chauffeur, the Chauffeur personally, and DRYVE247 LTD.
5. Eligibility
Every Chauffeur operating under this Agreement must:
Be at least twenty-five (25) years of age;
Hold a valid DVLA Class C, D, or Professional Driving Licence with a minimum of three (3) years of verifiable driving experience;
Have successfully cleared an official criminal record background check issued by the Criminal Investigations Department (CID) of the Ghana Police Service;
Have passed mandatory medical and visual acuity examinations;
Have completed the DRYVE247 Professional Chauffeur Training and signed the Chauffeur Code of Conduct (Document 71).
6. Rights
Safety Discretion: The Chauffeur retains paramount authority and discretion to decline driving into areas that present imminent physical peril, civil unrest, flooding, severe road degradation, or where instructed by the Renter to exceed speed limits or violate traffic laws.
Mandatory Rest Periods: The Chauffeur is entitled to statutory rest periods, including a mandatory thirty (30) minute break following four (4) continuous hours of driving, and a maximum operational limit of ten (10) driving hours within any twenty-four (24) hour window.
Respect and Dignity: The Chauffeur has the constitutional right under Article 15 of the 1992 Constitution to work free from verbal abuse, threats, racial or social discrimination, and physical violence.
7. Responsibilities
Sole Operator: The Chauffeur shall remain the exclusive driver of the Vehicle throughout the trip. Under no circumstances may the Chauffeur surrender control of the steering wheel to the Renter or any passenger.
Professional Demeanor: The Chauffeur must maintain professional grooming, wear clean business attire, observe punctuality, maintain passenger confidentiality, and drive defensively.
Vehicle Safeguarding: The Chauffeur is responsible for securing the Vehicle, monitoring fluid levels, ensuring parking safety, and maintaining the cleanliness of the passenger cabin.
8. Prohibited Conduct
The Chauffeur shall NOT:
Consume any alcohol, narcotics, or medications impairing motor reflexes within twelve (12) hours prior to or during a Chauffeured Booking;
Solicit personal tips, direct payments, off-platform future work, or side-arrangements from the Renter;
Use mobile devices while driving, except for hands-free navigation operations;
Carry unauthorized third parties, friends, or family members in the Vehicle during an active booking.
9. Operational Procedures
Dispatch and Introduction: Prior to trip commencement, the Chauffeur’s name, verified photo, contact number, and licence status are transmitted to the Renter via the Platform.
Itinerary Coordination: The Renter coordinates pickup times and destinations through the Platform or directly with the Chauffeur within the bounds of the booked itinerary.
Logistics for Inter-City Travel: For multi-day trips outside Greater Accra, the provision of Chauffeur accommodation, meals, or standardized daily per-diem allowances must follow the fee structures specified at checkout.
10. Evidence and Documentation Requirements
The Chauffeur must execute the digital Check-In and Check-Out protocols on their driver interface, recording starting and ending mileage, fuel levels, and documenting any en-route vehicle incidents or mechanical issues.
11. Payments and Financial Consequences
Chauffeur Rates: Chauffeur service fees are pre-calculated and billed to the Renter at checkout, including platform service fees and driver allowances.
Excess Hours Surcharges: Operating past the agreed booking window incurs automated overtime billing at standard platform hourly rates, debited from the Renter’s authorized payment method.
Misconduct Penalties: A Chauffeur who abandons a Renter, arrives more than thirty (30) minutes late without valid excuse, or violates safety rules will forfeit trip earnings and face immediate platform deactivation.
12 Independent Insurance Responsibilities
Independent Chauffeur Insurance: The Host must confirm directly with its insurer that the intended chauffeur and use are permitted. Platform dispatch does not create or extend coverage. Any Renter damage liability is determined by proven responsibility, the booking terms and Document 11; no insurance payment or automatic exemption is promised by DRYVE247.
13. Privacy and Data Protection
The Chauffeur covenants to maintain strict passenger confidentiality regarding all conversations, personal activities, business discussions, and travel destinations observed during the trip. Breaching passenger privacy violates Act 843 and results in instant termination and potential civil liability.
14. Safety Obligations
The Chauffeur must strictly enforce seatbelt usage for all passengers and adhere to national speed limits established under the Road Traffic Regulations, 2012 (L.I. 2180).
15. Reporting Obligations
The Chauffeur must immediately report any accident, mechanical failure, medical emergency, or passenger dispute to DRYVE247 Trust & Safety via the emergency dispatch hotline.
16. Disputes
Disputes arising from Chauffeured services (e.g., punctuality, itinerary disagreements, driver conduct) shall be evaluated by DRYVE247 Support, which holds authority to issue partial refunds, driver credits, or reassignment.
17. Enforcement
DRYVE247 exercises zero tolerance for safety infractions. Any substantiated complaint regarding reckless driving, intoxication, or harassment results in immediate revocation of Chauffeur platform credentials.
18. Suspension and Termination
A Chauffeur’s platform access may be terminated at any time for violation of the Chauffeur Code of Conduct, driving licence suspension, or criminal charges.
19. Applicable Law
This Agreement is governed by the laws of the Republic of Ghana, including the Labour Act, 2003 (Act 651) where applicable to employment or contractor relationships.
20. International Users
International travelers booking chauffeured services in Ghana are protected by these terms and agree that local road transport standards apply.
21. Amendments
Updates to these terms will be published on the Platform and distributed to active Chauffeurs and Hosts.
22. Severability
If any provision is deemed unenforceable, all other clauses remain valid and binding.
